Terms and Conditions

1. DEFINITIONS

Booking: A confirmed reservation of a Service made by a Guest in writing and accepted by the Service Provider.

Service Provider: Island Discovery d.o.o., a company registered under the laws of the Republic of Croatia, with its registered address at Podstrana 21312, Split, Croatia.

Services: Boat tours provided directly by the Service Provider or by Third-Party Providers.

Payment Provider: The designated payment processing provider responsible for handling transactions on the Booking Site, currently Stripe (https://stripe.com/).

Service Fee: The amount payable by the Guest to the Service Provider for the provision of Services. The Service Provider may adjust the Service Fee for promotional or business reasons. The Service Fee is invoiced for each Booking.

Guest: An individual of legal age and full contractual capacity, or a legally represented entity, that enters into an agreement with the Service Provider and agrees to pay the Booking Fee.

Third-Party Providers: External providers involved in delivering aspects of the Services, including but not limited to Other Boat Operators.

We/Us/Our: The Service Provider, Island Discovery d.o.o.

Booking Site: The online platform operated by the Service Provider, accessible at https://www.islanddiscovery.life.

You/Your: Guests and Other Boat Operators, as applicable.

Terms & Conditions: This legally binding agreement governing the Guest's use of the Booking Site, Services, and related products.

2. GENERAL TERMS AND CONDITIONS

2.1 These Terms and Conditions govern the Services provided by Island Discovery d.o.o.

2.2 By making a booking or participating in a tour, you agree to be bound by these Terms and Conditions.

2.3 Guests must also agree to the Privacy Policy and Liability Waiver & Equipment Responsibility Agreement before participation.
2.4 The Service Provider reserves the right to refuse service or deny participation at its sole discretion to ensure safety, compliance, or protect its interests.

2.5 The Service Provider reserves the right to update, revise, or modify these Terms at any time. Significant changes will be communicated via email or website updates.

3. BOOKINGS AND RESERVATIONS

3.1 Booking Process

3.1.1 All bookings must be made through the Booking Site, authorized agents, in person, or via telephone.

3.1.2 The Guest must be at least 18 years old to make a booking.

3.1.3 Bookings are confirmed only after full payment has been received and a confirmation email has been issued.

3.2 Accuracy of Information

3.2.1 The Guest must provide accurate information during the booking process.

3.2.2 Any discrepancies must be reported immediately to info@islanddiscovery.life.

3.2.3 The Service Provider is not liable for issues resulting from inaccurate or incomplete information provided by the Guest.

3.3 Amendments and Cancellations

3.3.1 Requests for booking amendments are subject to availability and may incur additional charges.

3.3.2 Cancellations must be submitted in writing.

4. PAYMENT TERMS

4.1 Payments can be made in full at the time of booking or with a 50% deposit, with the remaining balance due on the day of the tour.

4.2 The Service Provider reserves the right to process outstanding balances, damages, or loss claims using the provided payment method, in accordance with the Guest’s acceptance of the Liability Waiver & Equipment Responsibility Agreement, including in cases of no-shows.

4.3 Accepted payment methods include major credit/debit cards and cash (for in-person bookings).

5. INSURANCE

5.1 Guests are responsible for securing adequate travel insurance. The Service Provider is not liable for any incidents arising from a lack of insurance coverage.

5.2 The Service Provider reserves the right to process outstanding balances, damages, or loss claims using the provided payment method, in accordance with the Guest’s acceptance of the Liability Waiver & Equipment Responsibility Agreement.

6. PRICING

6.1 Service Fees listed on the Booking Site are final but subject to change based on fuel costs or third-party service charges.

7. CANCELLATION POLICY

7.1 Guest Cancellations

7.1.1 Cancellations made at least 72 hours before the scheduled tour qualify for a full refund.

7.1.2 Cancellations within 72 hours of departure are non-refundable.

7.1.3 No-shows without prior cancellation are considered a forfeiture of the booking, and no refund or rescheduling will be provided. Additionally, the Service Provider reserves the right to charge the remaining 50% of the booking cost to the card used for the initial payment in accordance with Section 4.2.

7.2 Service Provider Cancellations

7.2.1 The Service Provider reserves the right to cancel tours due to adverse weather or safety concerns. Guests will receive a full refund or the option to reschedule.

7.3 Minimum Guest Requirement

7.3.1 A minimum of six guests is required per tour. If this threshold is not met, the Service Provider may cancel or reschedule the tour.

8. FORCE MAJEURE

8.1 The Service Provider is not liable for delays or cancellations due to unforeseen circumstances such as natural disasters or government restrictions.

9. CUSTOMER OBLIGATIONS

9.1 Guests must comply with safety guidelines and crew instructions.

9.2 Guests are financially responsible for damages they cause to the boat or equipment due to negligence. Private charter bookings may require a refundable security deposit.

9.3 The Service Provider reserves the right to refuse service to intoxicated or disruptive individuals without refund.

9.4 Guests acknowledge and accept full financial responsibility for the loss, theft, or damage of any equipment provided during Services. Guests expressly authorize Island Discovery d.o.o. to recover repair or replacement costs using the payment details provided during booking, in accordance with GDPR-compliant processing. Including, but not limited to:

  • Mask & Snorkel (€35 per set)

  • SUP Paddle (€180)

  • Stand-Up Paddleboard (SUP) (€710)

  • Underwater Scooter (€4000)

Guests authorize Island Discovery d.o.o. to charge the provided payment method or security deposit to cover repair or replacement costs resulting from negligence, misuse, or failure to comply with safety instructions.

9.5 Island Discovery d.o.o. and its staff reserve the right to deny or terminate a Guest’s participation in any Service if:

  • The Guest fails to comply with safety instructions;

  • Is under the influence of alcohol or substances impairing judgment;

  • Exhibits disruptive or unsafe behavior;

  • Is deemed medically or physically unfit;

  • Environmental or safety concerns arise.

No refunds will be provided in such cases, and the Guest remains responsible for any incurred costs.

9.6 Personal data related to bookings, payments, and equipment responsibilities may be processed to enforce payment obligations, as detailed in the Privacy Policy.

10. HEALTH AND SAFETY

10.1 Guests must disclose any medical conditions that could affect their participation.

10.2 The Service Provider reserves the right to deny participation if a Guest is deemed unfit for safety reasons.

10.3 Life jackets and safety briefings are provided before each tour.

10.4 By participating, Guests confirm they have received mandatory safety instructions from Island Discovery d.o.o. staff, including guidelines on equipment use and emergency procedures.
10.5 Island Discovery d.o.o. reserves the right to deny or revoke participation if a Guest poses a risk to themselves, others, or to the Service Provider’s equipment or property.

11. LIABILITY 

11.1 The Service Provider shall not be held liable for any injury, loss, theft, or damage to personal belongings, or any personal damages suffered by Guests during participation in Services, except where such damages are the direct result of the Service Provider’s gross negligence or wilful misconduct.

11.2 The Service Provider assumes no liability for:

  • Loss, theft, or damage to personal property, including but not limited to mobile phones, cameras, luggage, or valuables.

  • Personal injuries sustained through accidents, slips, falls, or misuse of equipment by Guests.

  • Any damages arising from the conduct, negligence, or omissions of Third-Party Providers.

  • Damages caused by adverse weather conditions, sea conditions, or natural disasters (force majeure).

11.3 Guests agree to indemnify, defend, and hold harmless Island Discovery d.o.o., its employees, and agents from any claims, damages, or legal fees resulting from the Guest’s actions, negligence, or failure to adhere to safety instructions during the Services.

11.4 Guests are advised to obtain comprehensive travel, health, and personal belongings insurance covering the aforementioned risks.

12. COMPLAINTS AND DISPUTES

12.1 Complaints must be reported to the tour guide or management during the tour for resolution.

12.2 Formal complaints must be submitted in writing within seven days of the tour.

12.3 Disputes shall be resolved under Croatian law.

13. GOVERNING LAW AND JURISDICTION

13.1 These Terms and Conditions are governed by the laws of Croatia. Disputes shall be resolved in Croatian courts.

14. AMENDMENTS

14.1 The Service Provider reserves the right to amend these Terms and Conditions at any time. Updates will be communicated via the website or email.

15. GUEST RESPONSIBILITIES & INDEMNITY 

15.1 Guests shall be held financially responsible for any damages, breakages, or losses caused intentionally or negligently to the boat, equipment, facilities, or property of the Service Provider or Third-Party Providers.

15.2 In the event of such damages, the Service Provider reserves the right to claim compensation equivalent to the repair, replacement, or restoration cost from the Guest, including administrative and legal expenses if applicable.

15.3 Guests agree to indemnify and hold harmless the Service Provider, its employees, agents, and Third-Party Providers from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with:

  • Their participation in Services.

  • Their breach of these Terms and Conditions.

  • Any act of negligence, misconduct, or violation of applicable laws or regulations.

15.4 Guests explicitly agree that payment details provided during booking may be used to recover costs arising from damages, losses, or breaches of these Terms & Conditions, as permitted by applicable data protection regulations and outlined in the Privacy Policy.

16. LIMITATION OF LIABILITY

16.1 To the fullest extent permitted by law, the Service Provider’s total liability under these Terms and Conditions shall not exceed the amount paid by the Guest for the specific Service giving rise to the liability.

16.2 In no event shall the Service Provider be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of enjoyment, emotional distress, loss of profits, or loss of data.
