1. PARTICIPATION ACKNOWLEDGMENT

I hereby acknowledge that I have voluntarily chosen to participate in boat tours, water sports, and related activities (“Services”) organized by Island Discovery d.o.o.

I understand that these activities involve inherent risks, including but not limited to slips, falls, collisions, equipment failure, drowning, and adverse weather conditions.

I voluntarily assume full responsibility for any risks, injuries, damages, or losses that may occur during my participation, except where caused by the gross negligence or wilful misconduct of Island Discovery d.o.o.

2. SAFETY INSTRUCTIONS RECEIPT & ACCEPTANCE

I confirm that I have received, understood, and will comply with the safety instructions and guidelines provided by Island Discovery d.o.o. staff prior to the commencement of the Services.

I acknowledge that I had the opportunity to ask questions regarding safety procedures and the proper use of all provided equipment.

3. EQUIPMENT RESPONSIBILITY

I understand that during the course of the Services, I may be provided with various equipment, including but not limited to:

I agree to use all equipment responsibly and follow the safety instructions provided by Island Discovery staff. I accept full financial responsibility for the repair or replacement costs of any equipment that is lost, stolen, or damaged due to my negligence, misuse, or failure to comply with safety guidelines.

I authorize Island Discovery d.o.o. to charge my credit/debit card or deduct from any provided security deposit the corresponding amount for such losses or damages.

4. RIGHT TO DENY SERVICE

I acknowledge and accept that Island Discovery d.o.o. and its staff reserve the right to deny my participation in any Service, or the continued use of any equipment, at their sole discretion. This includes, but is not limited to:

• Situations where I fail to follow safety instructions or guidelines;

• If I am deemed to be under the influence of alcohol, drugs, or any substances impairing my judgment;

• If my behaviour is disruptive, poses a risk to myself, other guests, or staff;

• If I am physically unfit or deemed medically unsafe to participate;

• In the event of adverse weather or other safety concerns.

In such cases, no refunds shall be provided, and any additional costs incurred as a result of my removal from the activity shall be my sole responsibility.

5. RELEASE OF LIABILITY

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless Island Discovery d.o.o., its owners, employees, agents, and affiliated Third-Party Providers from any and all claims, liabilities, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me or my property while participating in the Services.

6. INDEMNITY AGREEMENT

I agree to indemnify and defend Island Discovery d.o.o. against any claims, damages, or expenses, including legal fees, arising out of my actions, negligence, misconduct, or failure to follow instructions during the Services.

7. MEDICAL CONDITIONS & FITNESS TO PARTICIPATE

I confirm that I am physically fit and have no medical conditions that would affect my ability to safely participate in the Services. I agree to disclose any relevant health information to Island Discovery d.o.o. prior to participation.

8. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the Republic of Croatia. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of Croatian courts.
